In the search for full autonomy for Local Government Areas in Nigeria, the Government of President Bola Ahmed Tinubu has instituted a legal action against the Governors of the 36 States of the Federation at the Supreme Court over alleged misconduct in the administration of Local Government Areas, LGAs.
The Attorney General of the Federation and Minister of Justice, Prince Lateef Fagbemi, SAN, is seeking full autonomy for all LGAs as the third tier of government in a suit marked: SC/CV/343/2024, which was filed recently.
The suit is seeking divine intervention and guidance of the apex court, the highest authority in our land, to issue an order that promotes justice and upholds the democratic principles.
Specifically, the FG is asking that the court to:
1. Prohibits state governors from unilaterally, arbitrarily, and unlawfully dissolving democratically elected local government leaders.
2. Permits the funds standing in the credits of local governments to be directly channelled to them from the Federation Account, in line with the provisions of the Constitution.
3. An order, stopping governors from further constituting Caretaker Committees to run the affairs of local governments as against the Constitutionally recognized democratic system.
4. The governors of the 36 states of the federation were sued through their respective Attorney Generals.
FG praying that the court recognizes the failure of governors to put a democratically elected local government system in place as a deliberate subversion of the 1999 Constitution, which they and the President have sworn to uphold. We pray that the court holds them accountable for this violation and takes steps to ensure that the constitutional rights of local governments and their citizens are respected.

Nigerians are hoping that finally, a law will be re-established to prohibits state governors from unilaterally, arbitrarily, and unlawfully dissolving democratically elected local government leaders. This suit which has been a dying wish of millions of Nigerians are now praying for a judgment that respects the will of the people and ensures that their elected representatives are allowed to serve their terms without fear of unjust removal.
We also hope that the court’s decision will be guided by wisdom, fairness, and a commitment to upholding the rule of law. May it bring peace, stability, and progress to our nation, and may it be a beacon of renewed hope for democracy and good governance.
However, the Supreme Court has fixed May 30 to hear the suit.
